This Refund & Cancellation Policy (the "Policy") is issued by Smartreview AI Pvt Ltd (CIN: U62091KA2026PTC223899), a company incorporated under the laws of India with its registered office at H.No B-2, 15th Cross, Bommanahalli, Bangalore, Karnataka, India – 560068 ("Smartreview AI", "we", "us", "our").
This Policy applies globally to all fees, charges, and payments of any kind made to Smartreview AI in connection with our website (www.smartreviewai.io), platform, subscriptions, listings, assessment and certification services, evaluation processes, API access, and any other products or services we provide (collectively, the "Services"), regardless of the country from which you purchase or access the Services. It applies to all Customers/Partners and other paying parties ("you").
This Policy is incorporated by reference into, and forms part of, our Terms & Conditions, the Master Services Agreement, and each Order Form. By purchasing, subscribing to, or paying for any Services, you acknowledge that you have read, understood, and agreed to this Policy. Where a signed agreement expressly states a different refund term for a specific transaction, that signed agreement controls for that transaction only.
ALL FEES AND CHARGES PAID TO SMARTREVIEW AI ARE FINAL, NON-REFUNDABLE, NON-CANCELLABLE, NON-CREDITABLE, AND NON-TRANSFERABLE.
We do not provide refunds, credits, set-offs, or reimbursements of any kind, in whole or in part, for any reason whatsoever, except only where a refund is expressly required by non-waivable applicable law (see Section 08). This no-refund position is a fundamental commercial basis on which the Services are priced and offered, and you agree that it is reasonable given the nature of the Services.
Fees are paid solely for access to the Services and for the administrative process of evaluation, assessment, and certification. Fees are never paid for, and can never influence, any particular score, ranking, rating, badge, certification, or outcome. Accordingly, no refund, credit, or discount will be provided because:
Having paid fees, you may not assert that those fees entitle you to any particular outcome or to a refund based on the outcome.
Subscriptions renew automatically for successive terms unless you cancel before the start of the next billing period, as set out in your Order Form or account settings. Cancellation takes effect only at the end of the then-current paid term. Cancellation stops future renewal charges; it does not entitle you to any refund or credit for the current term or any prior term, including for unused time, unused features, or unused capacity.
It is solely your responsibility to cancel before renewal. We are not obligated to refund charges arising from your failure to cancel on time, even if you did not use the Services during the renewed term.
Without limiting Section 01, no refund or credit will be given for any of the following (whether occurring alone or in combination):
If we suspend or terminate your account, access, listing, or certification because of your breach — including any attempt to manipulate reviews, scores, or audit outcomes — all fees paid are forfeited, all fees accrued or committed for the remainder of the then-current term become immediately due and payable, and no refund or credit of any kind will be given. These remedies are in addition to any other rights or remedies available to us.
All taxes, duties, levies, and similar governmental charges paid or payable in connection with the Services are non-refundable by Smartreview AI. Any recovery of taxes is solely between you and the relevant tax authority.
You agree to contact us at contact@smartreviewai.io before initiating any chargeback, payment reversal, or payment dispute. Initiating a chargeback or payment reversal in circumvention of this Policy is a material breach of your agreement with us. In such cases we may immediately suspend or terminate your account, access, listing, badge, and certification; contest the chargeback with evidence of this Policy and your acceptance of it; and recover from you the disputed amounts, chargeback fees, collection costs, and reasonable legal fees. Payments are processed by third-party payment processors; their processing terms do not create any refund right beyond this Policy.
The Services are business-to-business services supplied for business and professional use only, and consumer-protection refund regimes generally do not apply. If, and only to the extent that, a non-waivable mandatory law of your jurisdiction grants you a refund right that cannot lawfully be excluded, this Policy does not exclude that right; any such refund will be limited to the minimum amount and scope required by that law, and this Policy will otherwise continue to apply in full. Nothing in this Policy affects liability that cannot lawfully be excluded.
We may update this Policy from time to time at our sole discretion. The updated Policy will be posted on the Site with a revised effective date and applies to purchases and renewals made after posting. Your continued use of, or payment for, the Services after publication constitutes acceptance of the updated Policy.
This Policy is governed by the laws of India, and disputes are subject to the dispute-resolution provisions of the Terms & Conditions or, for Customers/Partners under the Master Services Agreement, that Agreement, with the courts at Bengaluru, Karnataka, India having jurisdiction where applicable, except where mandatory local law provides otherwise.
